The court of Bologna, Intellectual and Industrial Property section, rules as follows:
Versata FZ-LLC is prevented from diffusing untruthful and discrediting news about the activity of Think3 inc run by the Trustee;
- Versata FZ-LLC is prevented from using the “Think3” trademark, registered with n.001207893 on 16 June 1999, in whatever way, including inserting it in the web domain www.think3.versata.com;
- A euro 5.000,00 fine is applied for each violation of the previous orders and to be exact the “think3” name has to be removed from the web domain www.think3.versata.com within 15 days following the date of this communication of the sentence.
- The publication of this communication is authorized on the internet and the sentence can be officially published once in an industry journal of the choice of the trustee.
- The prosecuted party is ordered to pay the expenses of this case to the winner of euro 2,000 legal rights and euro 1,000 fees and euro 500 for expenses, plus CP and VAT as per the law
